1. Acceptance of Terms

By downloading, installing, or using the Wowmoji application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not download, install, or use the App. These Terms constitute a legally binding agreement between you and Wowmoji.

2. Eligibility

You must be at least 13 years of age (or the applicable age of digital consent in your jurisdiction) to use this App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have parental or guardian consent to use the App.

3. Description of Service

Wowmoji is an application that transforms photos into personalized emoji sticker images using artificial intelligence services. The App processes your photos through external AI services and generates custom emoji representations that can be used as WhatsApp stickers.

The quality and accuracy of generated stickers depend on various factors including image quality, lighting, facial positioning. Results may vary and are not guaranteed.

4. User Content and Representations

By uploading images to the App, you represent and warrant that:

You have the legal right to upload and use the image

The image does not infringe on any third party's intellectual property rights, privacy rights, publicity rights, or other legal rights

You are the person depicted in the image, or you have obtained explicit consent from the person depicted

The image does not contain illegal, harmful, obscene, or inappropriate content

You consent to the processing of the image by third-party AI services

The image does not depict minors without proper parental consent

You assume full responsibility for all content you upload. We are not responsible for verifying your rights to any uploaded content.

5. Data Handling and Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Key points:

Uploaded images are transmitted to third-party AI services (Google) for processing

We do not permanently store your uploaded images on our servers

Generated stickers are stored locally on your device only

Data is encrypted during transmission

By using the App, you consent to the transfer and processing of your images as described in our Privacy Policy.

6. Payment Terms

The App offers in-app purchases for sticker generation packages. By making a purchase, you acknowledge and agree:

Purchases are one-time payments, not recurring subscriptions

Payment is processed through the Apple App Store (iOS) or Google Play Store (Android)

Prices are displayed in your local currency and may vary by region

You are responsible for any applicable taxes

Refunds: All refund requests are handled by Apple or Google through their respective app stores in accordance with their refund policies. To request a refund, please contact Apple App Store Support or Google Play Support directly.

7. Service Availability and Limitations

You acknowledge and accept that:

The service depends on third-party AI providers and may be unavailable at times

Processing times vary based on server load and network conditions

The App may fail to create some or all stickers due to image quality, face detection limitations, API availability, or other technical factors

We do not guarantee any specific number of successful sticker generations

Service may be discontinued, modified, or suspended at any time without notice

Results depend on third-party AI capabilities which we do not control

8. User Responsibilities

You are solely responsible for:

Keeping the App open and active during sticker processing

Maintaining a stable internet connection during use

Ensuring sufficient device storage for generated stickers

Any loss of data or failed processing due to closing the App prematurely

Backing up any stickers you wish to preserve

No refunds or compensation will be provided for issues arising from user error or failure to meet these responsibilities.

9. Third-Party Services

The App integrates with third-party services:

AI Processing Services: We are not responsible for their processing, availability, or results.

WhatsApp: Stickers are formatted for WhatsApp. Your use of stickers within WhatsApp is subject to WhatsApp's terms of service.

App Stores: Purchases are governed by Apple App Store or Google Play Store terms.

We are not responsible for the actions, policies, or availability of any third-party services.

10. Intellectual Property

The App, including its design, user interface, features, code, and underlying technology, is the intellectual property of Wowmoji and its licensors, protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes only. This license does not include the right to modify, distribute, sell, or create derivative works of the App.

You retain rights to the generated sticker images for personal, non-commercial use only. Commercial use of generated stickers requires separate written permission.

Third-Party Open Source Content: Emoji graphics displayed in this App are provided by Twemoji, copyright Twitter, Inc and other contributors, licensed under CC-BY 4.0.

11. Prohibited Uses

You agree not to:

Use the App for any illegal, unauthorized, or fraudulent purpose

Upload images of persons without their explicit consent

Create content that is defamatory, obscene, harassing, threatening, or harmful

Attempt to reverse engineer, decompile, disassemble, or hack the App

Use the App to harass, bully, stalk, or impersonate others

Circumvent any security features or access restrictions

Use automated systems, bots, or scripts to access the App

Resell, redistribute, or commercially exploit the App or generated content

Violate any applicable laws, regulations, or third-party rights

Violation of these prohibitions may result in immediate termination of your access without refund.

12. Disclaimer of Warranties

THE APP AND ALL CONTENT, FEATURES, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT: (A) THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; (B) RESULTS WILL BE ACCURATE, RELIABLE, OR MEET YOUR EXPECTATIONS; (C) ANY ERRORS WILL BE CORRECTED; OR (D) THE APP WILL BE COMPATIBLE WITH YOUR DEVICE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WOWMOJI, ITS OPERATORS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF DATA, PROFITS, GOODWILL, USE, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OR INABILITY TO USE THE APP.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP EXCEED THE AMOUNT YOU PAID FOR THE APP OR IN-APP PURCHASES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY US DOLLARS ($50), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW LIMITATION OF LIABILITY FOR CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

14. Indemnification

You agree to indemnify, defend, and hold harmless Wowmoji, its operators, affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, losses, costs, liabilities, and expenses (including reasonable attorneys' fees) arising from or related to:

Your use or misuse of the App

Your violation of these Terms

Your violation of any third-party rights, including privacy or intellectual property rights

Content you upload or generate through the App

Your violation of any applicable laws or regulations

15. Termination

We reserve the right to suspend or terminate your access to the App at any time, without notice, for any reason, including but not limited to violation of these Terms. Upon termination, your license to use the App is immediately revoked. All provisions of these Terms that should survive termination shall survive, including intellectual property provisions, disclaimers, indemnification, and limitations of liability.

16. Force Majeure

We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, government actions, third-party service outages, internet or telecommunications failures, power outages, or pandemics.

17. Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue other available legal remedies.

You agree that any legal proceedings shall be conducted on an individual basis and not as a class action or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against us.

18. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. You consent to the exclusive jurisdiction of the competent courts for any disputes arising under these Terms.

19. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be indicated by updating the "Last Updated" date. Your continued use of the App after any modifications constitutes acceptance of the revised Terms. If you do not agree to the modified Terms, you must discontinue use of the App.

20. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Wowmoji regarding your use of the App and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.

22. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative.

23. Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
